INFORMATION CLAUSE FOR CONTRACTORS, PERSONS AUTHORIZED TO REPRESENT CONTRACTORS, AND CONTACT PERSONS ACTING ON BEHALF OF CONTRACTORS
Pursuant to the obligations under Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), we hereby inform you that:

Your personal data is processed based on:
- Art. 6(1)(b) GDPR — if you are a contractor of Horizons Sp. z o.o. — for the purpose of concluding and performing a contract to which you are a party;
- Art. 6(1)(a) GDPR — if you are an employee, associate, or authorized representative of a contractor of Horizons Sp. z o.o., and your data has been provided by your employer, principal, or directly by you — to perform a contract between Horizons Sp. z o.o. and your employer or principal; in this case, data processing is based on Art. 6(1)(f) GDPR (legitimate interest of the data controller).
Your personal data may also be processed based on:
- Art. 6(1)(f) GDPR — for the purposes of legitimate interests of Horizons Sp. z o.o. or a third party, such as direct marketing, claim establishment, pursuit, or defense related to contract performance;
- Art. 6(1)(a) GDPR — if you have given consent for specific purposes, including receiving commercial information by electronic means;
- Art. 6(1)(c) GDPR — when processing is necessary to fulfill legal obligations, including archiving obligations for tax purposes.
Horizons Sp. z o.o. processes regular personal data, in particular:
- For contractors: name, company name, business address, tax ID (NIP), REGON, contact details (e-mail, phone number);
- For contractor’s employees, associates, and representatives: name, job title, employer/principal details, professional contact information (e-mail, phone).
Providing personal data is voluntary but necessary for contract conclusion and execution. Failure to provide data may prevent contract signing or performance. In the case of data processed for marketing purposes (including with consent for electronic commercial information), failure to provide data will prevent the receipt of such information.
Horizons Sp. z o.o. usually obtains personal data directly from the data subjects. In cases referred to in point 2(b), data may be provided by the contractor acting as the employer or principal.
Your data may be shared with third parties (including affiliates), particularly email hosting providers, IT service providers, Horizons Sp. z o.o. contractors and subcontractors, couriers, and legal, tax, or advisory service providers.
Data will be processed during contract execution and afterward — until claims limitation periods expire and to comply with the five-year archiving obligation for tax purposes.
You have the right to request access, rectification, deletion, or restriction of processing of your personal data.
If your data is processed based on:
- Point 2(a) or Point 3(b) — you have the right to data portability if processing is automated;
- Point 2(b) or Point 3(a) — you have the right to object to processing based on your particular situation;
- Point 3(b) — you have the right to withdraw your consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.
You also have the right to lodge a complaint with the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw).
Your data will not be subject to automated decision-making, including profiling.
